The Senate Committee on Information, Communication and Technology (ICT) has rejected the Artificial Intelligence (AI) Bill, 2026, sponsored by nominated Senator Karen Nyamu, warning that its proposed penalties and regulatory requirements could discourage innovation, burden local technology businesses and drive investors away.
According to a letter dated February 2026, the proposed legislation sought to establish a legal framework for the development and use of AI in Kenya, including the creation of a dedicated regulator to oversee AI systems, assess risks and investigate breaches.
“The principal object of this Bill is to provide a comprehensive framework for the regulation and governance of artificial intelligence (AI) in Kenya, ensuring ethical, transparent, and accountable use while fostering innovation and safeguarding human rights, data protection, and public welfare,” read part of the bill.
