The High Court decision to uphold an order requiring a former wife to refund Ksh150,000 in bride price followed its consideration of the customary marriage arrangements and the responsibility for returning the dowry after the marriage ended.
In CKN v DMO case, delivered on December 8, 2023, Justice Magare Dennis Kizito Ng’wo addressed spousal maintenance, arguing that neither spouse should be required to maintain the other simply because of their gender.
Justice Magare stated that spousal maintenance centred on the constitutional principle that spouses have equal rights in marriage and when it ends.
